Water Regulator Threatens WPD’s Hyder Takeover
LCG, Aug. 28, 2000--The takeover of Welsh multi-utility Hyder by the U.S. joint venture Western Power Distribution Ltd. faces a new challenge by the British government after water utility Severn Trent raised questions about a WPD plan to turn the management of Hyders water business over to United Utilities, the Sunday Times of London reported yesterday.Philip Fletcher, who heads Ofwat, the water-industry regulator, has launched a probe into whether the plans breach license rules, the paper said. Ofwat requires water utilities to behave as independent firms, even if they are subsidiaries of a larger company.Allegations have been made that Hyder subsidiary Welsh Water did not have a say in the arrangements with United utilities. An Ofwat spokesman told the Times "We are in discussions with WPD following its bid being accepted by Hyder," adding that the United Utilities deal was part of the talks.Severn Trent, which maintains that the management deal for Welsh Water should have been put out for open bidding, learned last week that it would be able to challenge the arrangements in court on September 21. News of Ofwats probe will add weight to Severn Trent's battle with Hyder to overturn the United Utilities deal, the Times said.Western Power Distribution, a joint venture between The Southern Co. and PPL Corp. of the U.S., won Hyder on August 17 after a four-month bidding war with the Japanese bank Nomura International.
