Texas Cities Flock to Franchise Fee Suit Against TXU

LCG, Oct. 26, 2000--Lawyers for the city of Denton, Texas, which is suing TXU Electric & Gas Co. over alleged underpayment of franchise fees, said yesterday that 22 other cities in TXU's service area have joined in the suit and more are expected.

Franchise fees are what cities charge utilities for the right to tear up streets for pipelines and cables and to erect poles and string wires. They are a sort of rental charged for the use of public property. The franchise fees are based, in this case at least, on the utility's gross revenues from customers served.

The Denton lawsuit says the utility intentionally underpaid the city its franchise fees by not reporting its gross revenues. Denton's lawyers did not say what the company did report, but said the city claims TXU owes more than $1.17 million and the figure could turn out to be much higher. The total underpayment for all of the 22 cities could be more than $240 million, the lawyers said.

On top of that, if TXU intentionally underpaid the fees, Denton and the other cities would be entitled to punitive damages.
