Federal Court Orders California Power Sales Continue

LCG, Feb. 7, 2000A federal court judge late yesterday ordered Reliant Energy Services to keep selling electric power to California utilities despite the expiration of an order requiring it to do so.

The Bush administration allowed to expire at midnight yesterday an emergency order placed by the Clinton administration's Energy Secretary Bill Richardson and extended by current Energy Secretary Spencer Abraham.

Shortly before the deadline, Judge Frank Damrell in the U.S. District Court in Sacramento issued a temporary restraining order requiring Reliant to continue selling juice to Pacific Gas & Electric Co. and Southern California Edison Co., pending a hearing this afternoon.

Halting the sales, the judge said, would cause "obvious, irreparable harm to the public."

Two other major power suppliers were not included in the order. AES Pacific Inc. and Dynegy Power Corp. had agreed earlier to continue supplying power at least until this afternoon's hearing.

The restraining order had been sought by the California Independent System Operator. The ISO says the power producers signed agreements promising to provide power in an emergency. Yesterday, Cal-ISO declared its 22nd straight Stage 3 power emergency.
