High Court Backs EPA on Clean Air Rules

LCG, Feb. 28, 2001The U.S. Supreme Court yesterday supported the rulemaking authority of the Environmental Protection Agency, rejecting unanimously industry arguments that the agency must consider cost as well as public health in writing standards.

In what could be the most significant environmental case since the Clean Air Act became law in 1970, the court rejected industry arguments that the EPA went beyond the authority granted by Congress when it set tough new ozone standards in 1997.

Justice Antonin Scalia wrote for the court that the Clean air Act "unambiguously bars cost considerations" from being a factor in setting air-quality standards.

The court did, however, tell the EPA to come up with more reasonable procedures for enforcing new ozone rules.

The American Trucking Association, which had led the court protest of EPA rulemaking procedures, said it was "clearly disappointed" and added that its objective was to "obtain clear, understandable legal standards to promote clean air in a sensible fashion."

Incoming EPA Administrator Christine Whitman called the ruling "a solid endorsement of EPA'sefforts to protect the health of millions of Americans from the dangers of air pollution."
