Ohio Orders Utility to Take Over for Failed Firm
LCG, March 30, 2001The Public Utilities Commission of Ohio yesterday directed Columbia Gas of Ohio Inc. to take over operations of a small, failed natural gas distribution company until a new owner is found for the bankrupt firm or its customers switch to propane or find another source of energy. On February 13, West Milgrove Gas Co., which serves 120 customers, filed a Chapter 7 bankruptcy petition in a U.S. District Bankruptcy Court. The court promptly issued an order authorizing the bankruptcy to operate the company for 45 days only. Time's up today. In yesterday's order, Ohio regulators said it "appears to us that without some further emergency action, West Milgrove's customers may cease to receive gas service on March 30, 2001." Having reached that conclusion, PUCO decided to "require a qualified entity to temporarily operate West Milgrove."Columbia Gas of Ohio is really qualified. It not only currently provides natural gas service in the same county, it has personnel and expertise located in the area of West Milgrove."This is an extraordinary measure due to the uniqueness of a regulated utility facing closure due tobankruptcy," said PUCO Chairman Alan Schriber. "Although customers may ultimately need to findan alternative fuel source, the PUCO staff will continue to explore all options to prevent serviceinterruptions."It's more or less fitting that Columbia Gas of Ohio has to take up the slack. When West Milgrove Gas got behind in its bills to sister company Columbia Gas Transmission Co., Columbia began action to shut off its supply to West Milgrove Gas.
