Enron Takes India to Arbitration over Electric Bill
LCG, April 5, 2001Enron India, the subcontinent unit of U.S. Enron Corp., has issued a notice of arbitration to the Indian government to try to recover 1.02 billion rupees ($21.88 million U.S.) it says is owed by the Maharashtra State Electricity Board for electricity delivered during December.Consistent with Indian practice, the Maharashtra State electricity Board fined Enron's Dabhol Power Co. 4 billion rupees and wants to deduct the amount it owes from the fine.To gain payment for power sold to the MSEB in October and November, Enron first invoked a guarantee by the State of Maharashtra, which was ignored, and then the sovereign guarantee of the federal government of India. India then pressured Maharashtra into paying MSEB's bills. This time around, the government of India has asked the MSEB and Enron to sort out the electric bill fine dispute first. The Enron notice of arbitration means the issue heard in the Court of Arbitration in London. "This step was necessary in order to preserve our rights in the project, and to ensure that all parties honor their existing contractual obligations," the company said in a statement.
