Niagara Mohawk Says NRG Should Fix Plants it Bought
LCG, July 16, 2001--Niagara Mohawk Power Corp. said Friday it asked a New York state court to rule that NRG Energy Inc. is responsible for repairs to two coal-fired power plants that NRG purchased from the New York utility. In 1999, Niagara Mohawk sold its C.R. Huntley Steam Station in Tonawanda and the Dunkirk Steam Station in Dunkirk to Minneapolis-based generator NRG. In May of last year, New York State environmental officials charged that some of the work at the two plants should have been considered major modifications which would have required tighter control under the federal Clean Air Act.Two months ago, the New York State Attorney General advised both companies of the intent to file suit on or after today, July 16, charging that the plants are in violation of the Clean Air Act.At issue is, who is to pay for any fixing that need to be done to the plants.Niagara Mohawk said in a statement past maintenance and repairs at the plants complied with all state and federal requirements in effect when the work was performed, and any fixing is NRG's responsibility. But, NRG says that the State of New York alleges Niagara Mohawk violated environmental laws between 1983 and 1998, while Niagara Mohawk owned and operated the Huntley and Dunkirk power plants and the state is seeking relief.NRG said it purchased the plants having been assured that they had no outstanding environmental liabilities. NRG has continued to operate these two plants in accordance with this understanding, it said.
