PG&E Challenges California Ratepayer Advocate

Pacific Gas & Electric Co. said yesterday it has asked the U.S. Bankruptcy Court for a preliminary injunction against the director of the California Office of Ratepayers Advocates, claiming the agency "seeks to circumvent the court's jurisdiction over administration of the estate and the plan of reorganization confirmation process."

According to PG&E, the California Public Utilities Commission's consumer watchdog has turned into something of a Nosy Parker, requesting all sorts of documents the company says "would typically be produced, if at all, only in response to a discovery request related to plan confirmation objections."

The utility harrumphed "This is information that, if discoverable at all, is properly requested only through discovery in this bankruptcy case and supervised by this court."

PG&E said the preliminary injunction it requested "seeks to prevent the director of (the Ratepayer Advocate's office) from requesting and obtaining the documents because the data request is an attempt to circumvent the bankruptcy court's exclusive jurisdiction to administer the case and control the plan confirmation process."

An observer at the San Francisco court said the Ratepayer Advocate was possibly fishing for documents that had already been denied to the CPUC.
