PG&E Files Claim Over Regulation of Plants

LCG, Jan. 18, 2002--PG&E yesterday announced it is seeking $4.1 billion it says it has not earned in the marketplace due to a law regulating the rates its remaining plants are allowed to charge.

According to a statement by the company, the deregulation law AB 1890 allowed the utility's plants that were not sold off to receive market rates, subject to federal oversight. Last winter, the legislature passed AB 6X as one of a series of measures meant to deal with the energy crisis. The effect of AB 6X was to prevent the plants from earning market rates, a change from AB 1890 which PG&E characterizes as a breach of contract.

The claim was directed to the state Victim Compensation and Government Claims Board, and seeks to remove nuclear and hydropower facilities from regulatory oversight by the Public Utilities Commission. The Board makes payments to victims of crime out of state funds.

A statement issued by the PUC called the maneuver "a frivolous act of desperation" by "a corporate scofflaw." Gov. Davis' spokesman Steve Maviglio said the claim was "another salvo in PG&E's war against the state's consumers."
