Lay Pulls Out of Hearings

LCG, Feb. 4, 2002--Lawyers for Ken Lay, the former Enron chairman, issued statements Sunday that Lay would not participate in hearings on Capitol Hill that he had earlier been scheduled to attend.

The sudden announcement was based on the lawyers' perception that "judgments have been reached and the tenor of the hearings will be prosecutorial." A report requested by Enron's board also had lain blame on Lay for having failed to pay close enough attention to accounting practices stemming from the company's numerous outside partnerships.

Aides for committees that had scheduled hearings have been in contact with Lay's lawyers through today, while members of the committees, such as the House Financial Services Committee and the House Energy and Commerce Committee, voted in the affirmative to issue subpoenas. Sen. Byron Dorgan said he believed that statements by legislators were not the reason for Lay's absence. He said, "I think Ken Lay was looking for a door. I think the release of the Power report on Saturday evening is a devastating indictment of very serious problems inside that corporation."

The House Energy and Commerce Committee is scheduled on Thursday to conduct hearings with Andrew Fastow, the chief financial officer, and Jeffrey Skilling, the former chief executive. Only Skilling is expected to testify, while Fastow will likely invoke the Fifth Amendment.
