California Assembly Advances Plant Inspection Bill

LCG, Apr. 9, 2002--Gov. Davis of California may this week consider a bill narrowly passed by the Assembly that would allow the state Public Utilities Commission to enforce a set of plant operations guidelines at privately owned power plants.

Outages for maintenance or unforeseen repairs are seen as a possible threat to the security of the state's power supply. Supporters of the measure, SB 39xx, believe that government inspections would prevent outages from driving up power prices. Loretta Lynch, president of the PUC, said the bill's passage is "a significant blow to generators that don't play by the rules."

Detractors think that if the bill were to be made law, its overall effect would be to discourage power companies from investing in new power plants. Bill Leonard, R-San Bernardino, said SB 39xx represents "a huge intrusion on private industry," and could lead to further blackouts.

The Senate has yet to vote on the bill. Gov. Davis, while in favor of the intentions behind the bill, has signalled he has to weigh the enforcement provisions before making a decision on whether he can sign the measure into law. The guidelines for plant operations would be determined by a three-person committee, and directly implemented by the PUC.
