California Files New Complaint Against Power Companies
LCG, Mar. 21, 2002--California's Attorney General Bill Lockyer filed a complaint with the Federal Energy Regulatory Commission on Wednesday, alleging that generators had not responded to record-keeping rules regarding their rates. In a prepared statement, Lockyer said, "by not filing their rates, either before of after the fact, wholesale power providers have managed to evade any meaningful rate regulation by FERC." The complaint said that generators had not filed quarterly explanations of their costs, and did not detail their rates with FERC when the state's Department of Water Resources made short-term purchases.FERC received a complaint from Lockyer in 2001 asking for up to $9 billion in charges to be refunded. The agency has said that it will have a response to that complaint in August, and has signaled that any refunds would not match the full amount California is seeking.Gary Ackerman, who represents the Western Power Trading Forum for generators and traders, said Lockyer's suit gives an inaccurate picture of the information generators were required by federal rules to report. "This has no basis in any federal legislation or statute. It's just not there," Ackerman told the Sacramento Bee.
