Correction: "Judge Rejects CA Refund Claims"

The article as first published on December 13, 2002, mistakenly referred to Federal Administrative Law Judge Bruce Birchman as a Federal Administrative Judge.

The former appointment is merit-based under the Administrative Procedure Act of 1946. By contrast, Administrative Judges may be hired and fired at will, and do not have statutory protections of Administrative Law Judges to ensure that decisions, which are rendered based on the hearing record, are fair and impartial. There are more than 1100 merit-appointed Administrative Law Judges at 29 federal agencies and departments. Energyonline regrets the error.
