Judges Again Question Bush Administration’s Interference in Cheney Energy Case

LCG, April 17, 2003Today Appellate Judges Harry Edwards and David Tatel indicated that the White House does not have legal grounds to stop a lower court from continuing with a case regarding the vice presidents energy contacts.

The Bush Administration had gone to the U.S. Circuit Court of Appeals in order to ask for the case to be blocked, a non-standard approach that appellate judges found lacking in legal basis.

Dick Cheney arranged an energy task force, or National Energy Policy Development Group, in order to develop 2001 energy policy for the nation. Non-partisan legal group Judicial Watch filed to see records of the task force and its participants names in April 2001 and then filed a lawsuit seeking the same information in July of 2001. The U.S. General Accounting Office also filed a suit against the energy task force in order to release the names of those participating but did not choose to appeal when a U.S. District Court judge dismissed the case in December last year.

In November of last year U.S. District Judge Emmet Sullivan ruled that the documents should be released or officials should provide reasonable evidence as to why such information should not be released. The Bush Administration then tried in the U.S. Court of Appeals for the District of Columbia to appeal Judge Sullivans ruling.

Clinton appointee Judge Tatel asserted that the Bush Administration has yet to show that it will be legally harmed due to the lower court, and Carter appointee Judge Edwards voiced his opinion to a government attorney, saying you have no authority to request appeals court intervention during a lawsuit, according to the Associated Press. Bush Sr. appointee Judge Raymond Randolph, also on the appeals panel, doubted the Bush Administrations action of seeking Appeals Court intervention as well.

The Bush Administration repeatedly asserts that private groups do not have the right to know about meetings between industry representatives and administration executives such as the vice president.

Among those known to have participated in Cheneys Energy Task Force is Kenneth Lay, former CEO and chairman of the Enron Corporation.
