Casino Joins Others Allowed to Exit Utility

LCG, June 2, 2003--The Nevada Public Utilities Commission allowed the Palms casino last Thursday to purchase power from a supplier other than the Nevada Power Co. utility, based in part on a determination that other customers would receive a net benefit from the exit.

The Palms is one of twelve large customers, all but two of which are casinos, that have received permission to leave the utility. Half of them later determined that they would remain customers of Nevada Power Co., while Imperial Palace and the Riviera are being allowed until June 9 to decide to opt out, or must give up the option of exiting. They wished to have a final determination in the case rather than more hearings at the request of Nevada Power, so that any negotiations they engaged in with a possible supplier would not have uncertainty hanging over them.

The Attorney General's Bureau of Consumer Protection was not allowed reconsideration in the matter of Imperial Palace and the Riviera, but had contended that Nevada Power's overall loss of generation sales might impact it more than would a lesser need for expensive power purchases, causing its customers costs to rise. This possibility would arise only if power prices were to drop, the Nevada Energy Buyers Network countered. The PUC will later carry out a calculation to determine what if any exit fee should be charged to Palms, after the casino chooses a date on which to leave the utility.
