California Governor Schwarzenegger Approves Global Warming Legislation

LCG, September 28, 2006--California Governor Arnold Schwarzenegger yesterday approved Assembly Bill 32, or the "Global Warming Solutions Act of 2006." The legislation includes a statewide cap on greenhouse gas (GHG) emissions from electric utilities, refineries, and other selected industries. The goal is to reduce GHG emissions 25% by 2020 in order to alleviate concerns of global warming that may be caused by such emissions.

The legislation is scheduled to be implemented in 2012. The California Air Resources Board will be responsible for developing the regulations, including an as-yet-to-be defined trading system, plus a mandatory reporting system to track emissions from the many sources.

The bill would allow for the governor to defer the cap deadline for one year in the event of extraordinary circumstances.

Related legislation awaiting the Governor's action is Senate Bill
1368, which is designed to prevent California utilities from executing long-term power purchase agreements for electricity from facilities that do not meet California's GHG standards.
